CAT Telecom files a lawsuit with the Administrative Court today to halt 3G auction organized by the National Telecommunications Commission (NTC), alleging that the NTC has no authority to arrange the auction.

The petition has been submitted to the Administrative Court on two grounds; the NTC does not have legal authority to organize 3G auction. According to the 2007 Constitution, the National Broadcasting and Telecommunications Commission (NBTC) is the authority for such an auction. The body has not yet been formed.

Another ground is that the 3G auction will directly affect the revenue of TOT and CAT, the 2G concession holders as the 3G bid winners can shift customers to the new 3G system immediately.

TOT and CAT are not qualified to enter the auction under the NTC’s criteria.

Previously, CAT Telecom’s labour union had made a petition to the Administrative Court to halt the license bidding, but it had been dismissed as the Court reasoned that the union did not have the right to file the case.
